Your data resides exclusively in our Tier III data center in Prague-Hostivař (U Plynárny 1450, 101 00). We maintain no replicas outside the EU/EEA. For disaster recovery, we offer geo-redundancy to a second Czech site in Brno.

Data Retention: We retain personal data for as long as necessary to fulfill the purposes described in this policy, or as required by law (typically 5 years after account closure for tax and compliance purposes). Usage analytics data is retained for 26 months.

Third-Party Sharing: We do not sell your personal data. We may share data with trusted service providers (payment processors, data center operators, auditing firms) who are contractually bound to process data only on our instructions and with adequate security measures. We may disclose data if required by law or to protect our rights.

Terms of Service

These Terms of Service ("Terms") govern your use of cloud storage services provided by CloudVault Storage s.r.o., registered at Revoluční 24, 110 00 Prague 1, Czech Republic, Company ID 045 67 891. By creating an account or using our services, you accept these Terms.

Service Description: CloudVault provides cloud-based data storage, backup, synchronization, and related services as described in your service plan. We grant you a non-exclusive, non-transferable right to use the services for your internal business operations. All services are provided "as is" subject to the SLA applicable to your plan.

Acceptable Use: You agree not to store or transmit any content that violates applicable law, infringes third-party rights, contains malicious code, or is otherwise harmful. You may not reverse-engineer, resell, or sublicense our services without written consent. You are responsible for all activity under your account and must maintain confidentiality of your credentials.

Intellectual Property: As between you and CloudVault, you retain all rights to your data. CloudVault owns all rights to the platform, software, branding, and documentation. You grant us a limited license to process your data solely for providing the services (e.g., storage, backup, technical support).

Limitation of Liability: To the maximum extent permitted by Czech law (Act No. 89/2012 Coll., Civil Code), CloudVault's aggregate liability for any claim arising from these Terms or the services shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if advised of the possibility. This limitation does not apply to liability for death or personal injury caused by negligence, or for fraud or willful misconduct.

Indemnification: You agree to indemnify and hold CloudVault harmless from any claims, damages, or expenses arising from your breach of these Terms, your misuse of the services, or your violation of any law or third-party right.

Termination: Either party may terminate the agreement with 30 days' written notice. CloudVault may terminate immediately if you breach these Terms or fail to pay fees. Upon termination, you have 30 days to retrieve your data; after that, we may permanently delete it. Fees are non-refundable except as specified in the SLA.

Governing Law: These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts in Prague, Czech Republic. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Risk Disclosure

Important Risk Information Regarding Cloud Storage Services

This disclosure applies to all cloud storage services provided by CloudVault Storage s.r.o. ("CloudVault"). By using our services, you acknowledge and accept the risks described below. This disclosure does not purport to identify all possible risks; you should carefully consider whether our services are appropriate for your specific circumstances.

Data Loss Risk: While CloudVault employs industry-standard redundancy (RAID, geo-replication, regular backups), no storage system can guarantee absolute protection against data loss. Events such as hardware failure, natural disasters, power outages, cyberattacks, or human error may result in partial or complete data loss. We strongly recommend maintaining independent backups of critical data. Our liability for data loss is limited as set forth in our Terms of Service and SLA.

Security Risks: CloudVault implements AES-256 encryption, TLS 1.3, firewalls, intrusion detection, and access controls. However, no security measure is infallible. Risks include unauthorized access, data breaches, ransomware attacks, insider threats, and zero-day vulnerabilities. You are responsible for maintaining strong account credentials, enabling multi-factor authentication, and securing your own network environment.

Service Availability: Our SLA guarantees 99.99% uptime, but service interruptions may occur due to maintenance, network issues, force majeure events (e.g., floods, earthquakes, war, terrorism), or third-party failures. CloudVault is not liable for downtime caused by factors outside our reasonable control. You should have contingency plans for service unavailability.

Regulatory & Compliance Risks: While CloudVault is GDPR compliant and ISO 27001 certified, regulatory requirements may change. You are responsible for ensuring that our services meet your specific compliance obligations (e.g., HIPAA, PCI-DSS, sector-specific regulations). Data residency commitments apply only to the primary storage location; replication for disaster recovery may involve additional EU sites.

No Guarantee of Specific Results: CloudVault makes no guarantees regarding specific performance outcomes, cost savings, or business benefits from using our services. Past performance and uptime statistics are historical and not indicative of future results. Any examples of client outcomes are illustrative and do not constitute a promise or guarantee.

Third-Party Services: Our services may integrate with third-party platforms (e.g., payment processors, analytics tools). CloudVault is not responsible for the security, availability, or practices of these third parties. You should review their terms and policies independently.
